On Some Issues about Punitive Damages of Intellectual Property
摘要
Abstract
Punitive damages of intellectual property are a kind of civil liability and are the premise of the traditional compensatory damages . They are different in function ,scope and calculation basis .Punitive damages of intellectual property have their own civil law basis ,which is decided by the particularity of intellectual property infringement and the public policy characteristics .The application of punitive damages for intellectual property is the requirement of good faith principle and the prohibition of the right abuse principle and is the embodiment of humanism in the civil law .关键词
