刍议建设项目压覆矿产资源处置
The Attempting Discussion on How to Dispose the Mineral Resources below Construction Projects
摘要
Abstract
How to correctly balance the relationship between conserving resources and guaranteeing the development, and dispose the mineral resources below construction projects in a scientiifc and reasonable way has become urgent problem to be solved by administrative department in charge of land and resources. This paper introduces the legal basis and provisions with regard to the disposition of mining rights below construction;and analyzes some cases in this regard. Through comparing with the practice what western developed countries have done, this paper proposes that we should proceed with a series of methods required for the disposition of mining rights below construction projects, including streamlining administration, delegating more powers, assessing in a scientiifc way, rational compensation, solving the problem in a consultative manner. In addition, compensation mechanism must be established; and opinions and suggestions on the disposal matters should be put forward clearly in the amendments to Mining Law.关键词
