Abstract
It is reasonable to provide for“the gravity of the circumstances” in the crime of infringing upon the per-sonal information of citizens, which, as a new type of crime, meets the requirement of plot offense theory and the requirement of judicial practices. However, there are many different opinions about the gravity of the circumstance. According to the theory of the plot offense, it should be considered from a comprehensive point of view. The nature of the information has a special effect on the gravity of the circumstance, and a comprehensive standard is more rea-sonable.关键词
