On the Nature of Technical Barriers

Abstract
The nature of technical barriers in the sense of the WTO rules is domestic regulations. The term“technology”in this context is not confined to the “technology” in the science scenario. All complex governance issues could be included in administrative regulations and therefore be subject to the disciplines by the transparency and necessity test requirements in both the domestic administrative law and the TBT Agreement. It is in this sense that the TBT agreement in its broad meaning should include the TBT agreement itself and the SPS, Domestic Regulation in GATs as well.关键词
