国家标准版权保护的法理基础与制度建设
Legal Basis and System Construction of Copyright Protection of National Standards
摘要
Abstract
The standard development is a creative process. The standard should be protected since it is the"work" stipulated in the Copyright Law. Many standard drafters are co-owners of standard copyright. Through agreement, the standard development organization becomes the actual right-holder of the standard copyright. Through theoretical analysis of the legal basis of copyright protection and comparative analysis of extraterritorial standards copyright policy, this article puts forward some policy suggestions on national standards copyright protection in China, which is expected to help with the establishment and perfection of standardization governance system in China.关键词
