Ecologicalization and Privatization of Emission Right
摘要
Abstract
The ecological production requires that no harm to environment.Pollution discharge, however, is inevitable in the production process.It seems that pollution control and economic development is a paradox that cannot be paralleled.emission behavior can be adjusted in the form of property rights orientation, instead of dominated by the administrative act of government, a new pathway will be provided.From the perspective of private law, the property right orientation and marketization of emission either conform to the policy, or the step of market-orient economy development.To interpret the legal attribute of pollution discharge behavior, both the way of consideration of cost and profit in economics as well as innovation and breakthrough of civil law theory are required.The combination of both factors will lead to the answer to the new angle of environmental issues.关键词
