Abstract
In the mainland of China,confiscation of property means the confiscation of the criminal's legal property.For the existence of this kind of supplementary punishment,there are some criticism opinions in the academic circle in the mainland of China.According to the living constitution,combining the basic principles and idea of criminal law,confiscation of property lacks legitimacy and ought to be abolished.Certainly,two specific issues will arise as the abolition of the supplementary punishment.One is how to deal with funding crime,and the other is how to solve the difficulty of property attribute.关键词
