我国《渔业法》域外效力的强化——兼论负责任远洋渔业国家形象的维护
Strengthening Extraterritorial Effect of China's Fishery Law:Maintaining the Image of a Responsible Distant Water Fishing Nation
摘要
Abstract
In the increasing trend of strengthening conservation policy for marine fishery resources, it be-comes a prerequisite that the nations should actively fulfill their conservation obligations for the sustainable development of distant water fisheries. China needs to strengthen its fishery management in the context of frequent occurrence of overseas fishing incidents related to Chinese distant water fishing vessels. One of the effective means is to entitle full extraterritorial effect to China's Fishery Law.The full extraterritorial effect of the Fishery Law not only has a practical necessity but also jurisprudential basis in the legal,moral,econom-ic and political fields. It will contribute in maintaining China's international image as a responsible distant water fishing nation. The full extraterritorial effect should be established by China's Fisheries Law. There-fore,relevant provisions of the extraterritorial effect of Criminal Law should be referred and applicable rules for the full extraterritorial effect of the Fisheries Law should be made.关键词
