New Tendency of Section 337 Investigation and the Response of China

Abstract
[Purpose/Significance] Competitive intelligence is powerful in dealing with international trade disputes and barriers.With the advent of knowledge economy,the influence of intellectual property trade barrier on China's export trade is increasing.As a typical interna-tional trade barrier of intellectual property rights,"337 investigation" has become an important mean to restrict the development of China' s export trade.Significant changes have taken place in 337 investigations in 2016,which should be taken into account.[Method/Process] Beginning with the statistics of 337 investigations in 2016,this paper explores the changes in the 337 investigation rules by analyzing typical cases and forecasts the trends of the 337 investigation,then proposes some countermeasures for China from the perspective of competitive intelligence.[Results/Conclusion] The 337 investigation is an important area of competitive intelligence research.In order to cope with the tendency of the 337 investigation which is characterized by the intensity of trade protectionism,the expansion of jurisdiction,the changes of process and the rise of new investigation,an early warning mechanism for intellectual property should be established,competitive intelli-gence activities based on the 337 investigation should be organized,and the 337 investigation rules should be used to gain a favorable com-petitive position,which can make our enterprise response to the 337 investigation quickly.actively and flexibly.关键词
