Cooperation Under Deterrence: Conditional Non-prosecution System of Corporate Environmental Crime
摘要
Abstract
China pays more and more attention to the function of environmental criminal law. However, it is not enough just to emphasize deterrence of punishment. We also need to promote the participation of compa-nies in environmental governance and maximize the benefits of the society in a certain way. The conditional non-prosecution system can promote a company′s restoration of damaged environmental resources, and re-flects the company′s cooperation with the state in environmental governance. At present, there are still some conceptual and institutional obstacles in the non-prosecution system for corporate environmental crimes in China. We should vigorously work towards targets of overcoming these obstacles, perfect its application scope, conditions, contents and supervision, so as to ensure the effectiveness of the system.关键词
