我国环境行政公益诉讼程序规则体系的构建
Construction of China′s Environmental Administrative Public Interest Litigation Procedural System
摘要
Abstract
The new Administrative Procedure Law of the People′s Republic of China was revised and passed on June 27, 2017, marking the formal establishment and full implementation of the environmental adminis-trative public interest litigation system in China. To establish the environmental administrative public interest litigation procedural system in the ″post-legislation″ stage, we should apply a clear system of procedural rules. In terms of the construction mode of procedural rules system, we should choose appropriate adjust-ments in the existing administrative litigation framework. According to the temporal and spatial order of the litigation , a concrete design of the system in China should be carried out from four aspects respectively:pre-litigation procedure, prosecution and acceptance procedure, trial procedure and execution procedure.关键词
