摘要
Abstract
The new judicial interpretation has solved the problem of detention of bareboat chartering ships. And it associates maritime claims with ship property right. This kind of link originated from Anglo-American law system of action in rem. The introduction of the spirit has broken the principle of self-responsibility to some extent, and also facilitated the right realization of maritime claimant. In the specific legal provisions, this kind of regulations still need to be affirmed by substantive law, and cannot merely be based on the procedure law such as ship arrest.关键词
