《20世纪绝版图书数字化开发法令》述评及启示
Review and Enlightenment of the Law on the Digital Exploitation of-out-Print 20th Century Books

Abstract
Library’s digital exploitation of out-of-commerce works in its collections is hampered by copyright issues. For this reason, France has had proactive legislative explorations, placing the digitalization of out-of-commerce works under the implied copyright license system, which has the public welfare orientation of free license to libraries, as well as the features of convenient authorization, economies of scale, legal certainty and focus on protecting the interests of rights holders. China’s current implied license system of digital copyright is not specific to libraries, and has problems such as incomplete and imprecise regulations and lack of essential legal contents. It is suggested that China should proceed from current national conditions, borrow ideas from French legislation, and design a digital copyright solution for out-of-commerce works suitable for Chinese libraries.关键词
