The Key Problems that We Face in Managing the Contract of Mining Right Transfer

Abstract
Managing the contract of mining right transfer is proposed by "Reform Plan for the Mining Right Transfer System". In practice, mining right transfer has of both administrative permission and ownership register as well. And due to this double feature, there are some different opinions on the subject matter and the executed node of the contract. In view of this, this paper points out that in order to manage the contract of mining right transfer, we need clearly define the nature of mining right and mining right transfer contract in the process of revising the Mineral Resources Law; perform well in the basic and preparation job before transfer; explore the transfer of net mining rights; at the same time, in accordance with the principle of the consistency of power and responsibility, adjust the scope of examination and approval and enhance efforts to day-to-day supervision.关键词
