从美国《情报界指令》看美国情报界的法治精神∗
On the Spirit of Legality of the US Intelligence Community Based on the Intelligence Community Directives
摘要
Abstract
The US Intelligence Community Directives provide the policy basis and framework for the Director of National Intelligence to manage the national intelligence according to law, and reflect the spirit of legality of the US Intelligence Communi-ty. Studying the spirit of legality of the US Intelligence Community from the perspective of the Intelligence Community Directives can fur-ther the domestic research on the management of the US intelligence by law, and provide enlightenment for intelligence in China in both the system reform and the legal construction. [Method/ProcessBased on the Intelligence Community Directives as the basic material, this paper traces the background reasons for their establishment, sorts out their main contents, summarizes the spirit of legality reflected in them, and discusses the practical significance of the spirit of legality. [Result/ConclusionThe US Intelligence Community Directives re-flect the spirit of legality including Check and Balance, civil rights, and equality. Although those have brought many restrictions to intelli-gence to some extent, they have objectively promoted the sound development of the US intelligence.关键词
