环境法典编纂视阈下环境保护禁止令制度的完善
Improvement of Environmental Protection Injunction System From Perspective of Environmental Codification:Analysis Based on Insufficient Basis of Claim Rights
摘要
Abstract
The origin and development of the environmental protection injunction system were expounded,and the insufficient basis of the claim rights of the environmental protection injunction system and its reasons were analyzed.By examining the infringement risk and damage relief of public environmental rights,it was proposed that in the context of the codification of environmental codes,based on the theory of public environmental rights,the environmental protection injunction system should be incorporated into the environmental code,and the environmental protection injunction system should be specifically stipulated in the ecological and environmental responsibility part of the environmental code.The general provisions,application conditions,burden of proof,guarantee rules and legal liability of environmental protection injunction orders should be clarified,so as to further improve the responsibility system for environmental protection.关键词
