Abstract
The legal provisions,theoretical discussion and practical operation of the litigation forms for involving tort supplementary liability cases in China were expounded.The dilemma of substantive law and procedural law in determining the litigation form of involving tort supplementary liability cases was analyzed,and the factors that should be considered to solve the problem were clarified.It is believed that the determination of the litigation form of involving tort supplementary liability cases should comply with the basic theory of the civil procedure law and respect the plaintiff's freedom to exercise its of litigation right.关键词
