物业交接问题的行政法治理
Administrative Law Governance of Property Handover
摘要
Abstract
Currently,the governance of private law is in the stage of"positive adjustment"in the process of dealing with property handover issues,but there are still shortcomings such as long governance time,low repair efficiency,conflict between individual rights and communalisation,and resource constraints.Coordinated with private law governance,administrative law governance has the advantages of flexibility,compulsion,processual and gratuitousness.In order to solve the problem of property handover better,administrative law governance can be explored from the perspective of administrative responsibility.On the one hand,we should correct the bias of administrative guidance responsibility in the transfer activities,and deal with the relationship between administrative guidance and administrative decision,transparent guidance and public guidance,required-style guidance and forbidden-style guidance,guidance ability and temporal spirit.On the other hand,we should pay more attention to the shortcomings and reinforcement of the performance of administrative supervision responsibilities,improve the connection and cooperation between market supervision and property administrative supervision,set up direct enforcement of property companies in legislation,and fines on old properties should be regarded as means of enforcement penalties,etc.关键词
