Abstract
The normalized operation of the system of case handling by director and chief judge of the court has important theoretical value and practical significance to improve the quality and efficiency of trial organizations and alleviate the contradiction between personnel and cases in China's grassroots courts.Empirical research shows that,despite the current"institutionalized"case handling by director and chief judge of the court,they have a high proportion of posts and focus more on trial participation and simple cases.The direct consequence is to aggravate the contradiction between personnel and cases.At its root,the objective aspects are manifested in the need for the refinement of evaluation criteria for system of case handling by director and chief judge,the improvement of the allocation system of cases to the director and chief judge of the court,and the lack of a rigid supervision mechanism;subjectively,it is manifested by the lack of time for case handling by director and chief judge,reluctance to handle cases,and a lack of emphasis on case handling.Therefore,in order to alleviate the contradiction between personnel and cases,the grassroots courts urgently need to establish a systematic and operable long-term mechanism of case handling by director and chief judge.The purpose of this study is to provide new ideas for China's grassroots courts to promote the reform of the post system,the reform of the trial power operation mechanism,and the optimization of judicial resources,so as to alleviate the contradiction between personnel and cases.关键词
