The Applicable Rules of Discretion in Administrative Adjudication from the Perspective of Natural Resource Ownership Disputes
摘要
Abstract
From the perspective of disputes over ownership and use right of natural resources,this paper makes an empirical analysis of the discretion in administrative rulings,and sorts out the general steps of ad-ministrative organs when making decisions on disputes over ownership rights.Therefore,there are three charac-teristics of the application of discretion in administrative rulings:passive initiation of discretion,emphasis on substantive resolution of disputes for the purpose of discretion,and emphasis on individual differences for the result of discretion.In order to reduce the parties'distrust for the results of natural resources disputes,the con-trol of discretion in administrative rulings should be started from two aspects:administrative organs should ad-here to the principle of proportionality,especially the principle of justification of purpose,while judicial organs should mainly review the rationality of administrative acts after the event.关键词
