摘要

Abstract

Modern warfare,characterized by advanced technology and the widespread use of modern weap-onry,inflicts severe damage on the war zone environment and international order.It also poses a long-term threat to global ecological security and environmental human rights.Environmental protection during wartime is not only a legal obligation for the belligerent parties but also a fundamental responsibility that the international community must uphold.In practice,international environmental protection norms often take a backseat to the dominant application of armed conflict law during wartime,leading to challenges in holding parties accountable for wartime environmental damage.These challenges encompass issues such as confir-ming and sharing the responsibility for wartime environmental damage,invoking and enforcing international legal norms,and the political will and interests of conflicting parties.Furthermore,existing laws governing armed conflict struggle to provide adequate legal grounds for assigning responsibility for wartime environ-mental damage.Therefore,a shift from"soft law"to"hard law"regulation,with a focus on reconstructing the international legal framework primarily centered around wartime environmental protection,is not only necessary but also feasible.
