The Return of Users'Control of Personal Information:From the Perspective of Behavioral Law and Economics
摘要
Abstract
Although the privacy policy agreement provided by the personal information processor formally meets the requirements of the in-formed consent rule,there are still many unreasonable aspects,which affect the exercise of the right of control of personal information and dam-age the legitimate interests of users.Based on the research on the rational choice of users,behavioral law and economics describes the true inten-tion expression of authorized behavior,interprets the basis and core content of personal information control as"right to access"and"right to era-sure",clarifies the obligation of personal information processors relative to personal information control,and builds the operational framework of informed consent.According to the analysis of the content of the right of control of personal information,legislation should focus on clarify-ing the scope of the right of control,regulating the selection framework,improving the fiduciary duty of information,clarifying the usufruct of personal information,etc.,to provide an optimized path and institutional solution for the protection of personal information.关键词
