To Integrate or Not to Integrate:Judicial Value,Structural Function and Optimization Path of Regulation on the Personnel Management of Public Institutions

Abstract
Regulation on the Personnel Management of Public Institutions plays a fundamental role in the personnel management systems of Chinese public institutions.Nevertheless,it turns out that the number of personnel dispute litigation cases direct citing the Regulation is few,and most of them are in a state of"dormancy"according to the empirical investigation of judicial trials.However,this does not mean that the Regulation is short of practicalvalues,or that it is inessential to legislate on personnel management in public institutions.Actually,the Regulation works as a general overview to the personnel management system of public institutions,a link organically connecting the specific system enriching and developing themselves,and shows its importance in function and value as well.In the future,it is recommended with expectation to upgrade the legal hierarchy of the Regulation,to establish a complete personnel system of public institutions,which is supposed to be compatible with the non-profit of publicinstitutions,cover and guide all individual and special systems,and combine with unification and division of labor legal systems.关键词
