Study on the Construction of Integrated Governance Path of Administration,Civil and Criminal for Web Crawler
摘要
Abstract
As an emerging technology derived from the era of data,web crawler already has immeasurable positive effects at present,but what deserves more attention should be the intertwined legal risks behind it.Af-ter the analysis on the concept of web crawler and its positive and negative impacts,it can be found that on the basis of combining objective violation of law with subjective intention,there are many biases in the regulation of determining different crimes through different legal interests reflected by the crawled data types.Therefore,it is necessary to carry out integrated governance from administrative,civil and criminal perspectives by improving the cohesion mechanism of execution and punishment,externalizing the objective behavior as a whole with gen-eralized authorization,and clarifying the essence of the legal benefits of the crawled data,so as to create a new model of web crawler governance.关键词
