基于专利视角的经典名方研究分析
Research and Analysis of Classic Famous Prescriptions Based on Patent Perspective

Abstract
Objective To analyze the patent application situation of 100 classic famous prescriptions from Gu Dai Jing Dian Ming Fang Mu Lu(First Batch);To provide reference for the development and protection of classic famous prescriptions.Methods Patent data of 100 classic famous prescriptions from Gu Dai Jing Dian Ming Fang Mu Lu(First Batch)from January 1,1800 to July 14,2022 were retrieved in incoPat database.The data were analyzed from patent application volume,applicant,the legal status of patents,and patent subject.Results A total of 471 related patents were included,of which 465 were invention patents.The number of patent applications reached its peak in 2021,with 62%of patent applicants being enterprises.Among all patent applications,including 94 valid patents;among the authorized patents,the most common type was quality control/testing methods(51,54.3%).Conclusion At present,the patent protection situation of classic famous prescriptions in China is characterized by a small number of patent applications and low authorization rates,the main body of patent applications being enterprises,and a single type of patent theme;researchers can apply for patent protection for innovative research and development results generated during the research process of classic and famous medicinal ingredients and their mechanisms of action,modern production processes,and the consistency of quality and efficacy of ancient and modern formulations.关键词
