国际刑事法院被害人信托基金的赔偿功能研究
Study on the Reparation Function of the Trust Fund for Victims of the International Criminal Court
摘要
Abstract
The Rome Statute of the International Criminal Court created the Trust Fund for Victim,and one of its important functions is to implement the reparations orders of the Court.The Trust Fund has an inde-pendent Board of Directors and conducts effective cooperation with the International Criminal Court.Nowa-days,the challenges faced by the Trust Fund include that the scarce reparation resources cannot cover any harm which can be assessed to be a consequence of the crimes for which the accused has been convicted,the limited reparation capacity cannot meet people's high expectations,and the lack of reparation supervision mechanism to ensure the disbursemen of awards.To make the Trust Fund better play its reparation function,it is the Trust Fund rather than the Court who has the autonomy over"other resources"of the fund,approach the grant of reparations cautiously so that at a minimum the identified victims in the proceedings can be com-pensated,make good use of symbolic reparation methods and form a joint force with nations and other interna-tional organizations,to heal the trauma caused by crime to the victims and the community,prompt the trans-formation of the international criminal justice system from purely punitive justice model to restorative justice model.关键词
