地方环境立法系统性困境与出路探析
The Systemic Dilemma of Local Environmental Legislation and the Solutions

Abstract
Enhancing the systemic nature of local environmental legislation is the basis and necessity to improve the quality of local environmental legislation.From the viewpoint of system theory,the provincial environmental legislation in Fujian Province as a whole,from the selection of legislative topics,institutional norms to specific provisions,there are different degrees of legislative duplication,conflicts and gaps and other"unsystematic"dilemmas.The reasons for this are closely related to the unclear authority of local environmental legislation,the unsound mechanism of post-cleaning and other cor-rections,and the absence of prior legislative evaluation system.To this end,the division of authority within the local envi-ronmental legislation system should be clarified in legal form,and on this basis,the pre-evaluation system of local environ-mental legislation should be improved to prevent legislative fragmentation,the clean-up system of local legislation should be improved to eliminate legislative conflicts and duplication in a timely manner,and the local experience of"codification"should be explored to enhance the systemic nature of environmental legislation.The systematic nature of local environmental legislation and the quality of local environmental legislation would be improved through the two paths of"treating the symp-toms"and"treating the root causes".关键词
