围填海历史遗留问题处理的法律制度研究综述
A Review on the Legal System of Dealing with Historical Issues of Reclamation
摘要
Abstract
Since the 1980s,China has begun large-scale land reclamation activities.To date,many coastal areas have produced marine ecological environment problems,which makes the government and scholars generally realize that the rational withdrawal of reclamation projects is the most effective way to protect the ecological environment in coastal areas.Although China strictly controls reclamation projects,there are still problems such as large base number of historical problems left over from reclamation and many causes.Therefore,in order to achieve a reasonable withdrawal of reclamation works,it must be lawful and compliant.This paper reviews the research on the legal issues of the disposal of the historical problems left over from the external reclamation in China,generalizes the shortcomings of the current research,and puts forward policy suggestions on improving the relevant laws and regulations,perfecting the land reclamation system,and transforming the use right of sea area into the use right of land,so as to provide theoretical reference for the relevant research and practice.关键词
