Abstract
[Research purpose]With the continuous improvement of information technology,China's e-commerce is booming.At the same time,the growth of network disputes has followed.In the era of digital intelligence,civil disputes are characterized as a large number,a fast growth rate,a small target and a short settlement period.[Research method]The traditional litigation resolution mechanism has been difficult to meet the needs of China's online dispute resolution in the era of digital intelligence.The development of"internet plus"technology and the continuous advancement of the cyberspace governance pattern of"co-construction,co-governance and sharing"have led to the emergence of online dispute resolution mechanism.Online litigation and smart court construction in China belong to the application of ODR mechanism in the judicial field.ODR has broken through the non-litigation dispute resolution category of traditional Online ADR,realizing a new online trial mode of judicial litigation.Enterprises can directly declare and handle disputes through the internet,thus avoiding offline conflicts;the platform can collect consumers'complaints online and classify them,so as to master the problems arising from the process of their own products or services facing the market more efficiently,and then strengthen enterprise management and quality supervision,improve work,which is conducive to minimizing the adverse effects of enterprises.In practical application,there are still a series of problems in China's ODR mechanism,such as lack of legislation,inefficient implementation of ODR mechanism,and insufficient consumer trust.[Research conclusion]In this regard,we should improve the legislative provisions on consumer protection by ODR mechanism under the background of digital intelligence,cultivate people's new thinking paradigm to resolve contradictions and disputes,promote the popularity of online dispute resolution mechanism,strengthen the construction of"electronic credit",improve the preservation and relief measures,and enhance the platform construction and talent reserve of ODR mechanism to better promote the benign development of ODR mechanism in China.关键词
