碳排放权具有保护环境公共利益和控排企业私人财产利益的双重法律意义,因市场机制必须经过政府管控才能发挥减排效用,所以碳排放权受到行政规制具有正当性和必要性.政府没有干预碳排放权中财产利益的目的,碳排放权本身也没有对抗政府规制之意,因此,以权利受到行政规制为由认定碳排放权具有公法属性不符合公权利的定义.初始分配和清缴配额环节的公法属性或源于政府对配额的管理,或源于行政法律义务,但都无关碳排放权的法律属性.除了可交易性特征,碳排放权对控排企业支配配额财…查看全部>>
