Abstract
In recent years,Internet promoters have gradually developed into online spammer,but some traditional charges in the criminal law treat the symptoms rather than the root cause in the application of online spammer defamation,and the subject of crime is difficult to determine,and the lack of unit crime gives the net-work water army in the gray zone an opportunity.At the same time,under the collision between freedom of speech and order,criminal law should strictly abide by its principle of modesty,so as to protect human rights and optimize the allocation of judicial resources.In addition,it is necessary to define the conditions of crime more clearly,so as to make the recognition standard of judicial practice more operational and realize judicial fairness and justice.关键词
