A study on the path of integrating core socialist values into labor contract dispute adjudication
司法场域是践行社会主义核心价值观的载体之一,在应然层面上,社会主义核心价值观具有融入司法裁判的法源形式和价值正当性.分析劳动合同纠纷裁判中"诚信"司法适用存在的适用对象错位、说理简单、法官角色缺位与价值迷失等问题.探索可行的消解之道:在理念指引上,坚持裁判的"可预测性";在实效提升上,综合运用法律解释、推理和修辞方法.
