"枫桥经验"与诉源治理法治化
On the"Fengqiao Experience"Model and the Legalization of Litigation Source Governance
摘要
Abstract
Under the guidance of Xi Jinping Thought on the Rule of Law,the"Fengqiao Experience"model of resolving social conflicts at the grass-roots level is regaining popularity and strength in practice today.This model proves viable in addressing a series of governance-related issues in the New Era,gradually crystallizing into an important paradigm of experience in promoting governance at the grass-roots level under the leadership of the Communist Party of China(CPC).At present,conflicts and disputes at the grassroots level in China are still on an upward trend,and yet the disequilibrium between filings of lawsuits and the number of legal practitioners is still an acute issue.Therefore,to avoid China becoming"a country of litigation"with an exponential number of lawsuits filed each year,it is imperative that we adhere to and develop the"Fengqiao Experience"model in the New Era,push for the early detection,early prevention,early intervention,and early resolution of conflicts and disputes,and explore multiple avenues for diversified and comprehensive management of litigation sources.Under the leadership of the Party committees at the corresponding levels,a general paradigm of litigation source management should be established,a diversified system of resolving conflicts and disputes should be formed,and a legalized and intelligentized conflict resolution mechanism should be put in place.关键词
