论耕地保护中的土地经营主体
On land management subjects in cultivated land protection
摘要
Abstract
As a fundamental national policy,the protection of arable land should involve the government,land ownership enti-ties,land operation entities and other oriented.As the most direct user of arable land,land operation entities enjoy the right to ar-able land benefits,which determines its role as the direct bearer of arable land protection obligations and bears the adverse conse-quences for arable land destruction.However,the existing law are vague about the nature of land management rights and the con-tent of the land management contracts,making it difficult to stabilize the subjective intensions of the land operation entities in pro-tecting arable land;against the backdrop of imbalanced rights and obligations in arable land protection for land operation entities,it is difficult to provide regulatory guidance for arable land operation.Therefore,by empowering and returning rights,the partici-pation of land operation entities in arable land protection can be stimulated,especially in cases where the operating entity is the landowner.Legislation should clearly stipulate the general terms and forms of transfer contracts,providing a stable foundation for arable land investment.Through individual and market behavior constraints,as well as unilateral and joints constraints,the ara-ble land protection obligations of land protection entities can be constructed.关键词
