Judicial Advancement of the Modernization of Chinese-Style Rule of Law
摘要
Abstract
Achieving the modernization of Chinese-style rule of law entails the promotion of justice,which embodies the interplay between objectives and methodologies.The judicial advancement of the modernization of Chinese-style rule of law necessitates that judicial institutions,under the guidance of the Party,uphold the principles of justice and people's justice.This entails comprehensive action across legislation,law enforcement,and legal compliance through innovative judicial policies,systems,practices,and ideologies.Ultimately,the convergence of these"four forces"generates a synergistic"four-drive force"aimed at advancing the modernization of Chinese-style rule of law.Its fundamental characteristics include steadfast adherence to the Party's leadership within the leadership structure and perpetual guidance by the socialist rule of law theory with Chinese characteristics as the guiding ideology.With regard to the promotion strategy,the"four-dimensional linkage"comprising judicial policy,judicial system,judicial practice,and judicial ideology should be implemented.Emphasizing the value goal,priority is to be consistently given to the interests of the people.Throughout the process of modernizing Chinese-style rule of law,judicial promotion should focus on the practical advantages of reform cost,operational performance,and system provision,aligning closely with the theoretical coherence demanded by the essence of Chinese-style modernization.This demonstrates China's judicial acumen and illustrates the emergence of a new paradigm of judicial civilization.Future judicial promotion endeavors should consistently integrate such guiding concepts as"the Party as the helm""the people as the foundation""justice as the soul"and"science and technology as the means"into the entirety of judicial activities,thereby charting a new chapter in the civilization of the rule of law.关键词
