The Theoretical Provision and Realization of the Vision for Judicial Protection of Delinquent Minors
摘要
Abstract
Judicial protection of delinquent minors is a general requirement of social progress and human rights civilization,and it is also the embodiment of the rule of law to maximize the minor's interests.Its realization foundation is chiefly originated from the physical and mental health of minors and laws of juvenile justice.Also,the theoretical foundation includes parenspatriae theory,child welfare conception,social participation theory and others.The purpose of applying systems such as social investigation,appropriate adult participation and criminal records sealed,which follows principles of education first with punishment as a supporting approach,best interests of minors,special protection of rights and interests,lies in the special care for delinquent juveniles'interests.Judicial protection of delinquent minors is a systematic project,which requires the further improvement of the protection system in aspects of judicial ideas,legislative norms,team building and supervisory mechanism.These institutional advantages not only promote"administration of judicial protection of minors"with Chinese characteristics,but also motivate the modernization of governance system and capacity in judicial protection of delinquent minors.关键词
