沿海国管辖范围内的海洋渔业资源保护法律制度研究
Research on the legal ystem of Marine fishery resources protection within the jurisdiction of coastal States
摘要
Abstract
The issue of marine fishery resources is an important factor constraining the development of the marine e-conomy,and one of the major keys to the effective protection of marine fishery resources and the realization of the sustainable use of the oceans is the protection of offshore fishery resources.Based on the goal of sustainable devel-opment of offshore fisheries,this paper analyzes the main legal regimes f-or the protection of fishery resources with-in the jurisdiction of coastal States,discusses the scope of national maritime jurisdiction,and organizes the legal framework for the protection of fishery resources,within which the fishery resources conservation system,fishery subsidy system and fishery closure system are studied.In the analysis,it was found that,although the fishery re-sources protection system currently in place can have a positive impact on the recovery of fish stocks,there are still problems such as uncoordinated system design,incomplete coverage and weak long-term impact.In order to im-prove the fishery resources protection system in coastal countries,this paper,starting from China,envisions China's initiatives in the protection of the world's marine resources,with a view to providing ideas for the improvement of China's fishery resources protection system,and ultimately realizing the sustainable development of China's ma-rine fisheries and the creation of a blue economic growth.关键词
