功能导向下行政复议的价值取向与完善路径
Value Orientation and Perfect Path of Administrative Reconsideration under Function Orientation
摘要
Abstract
The administrative reconsideration system has three functions:dispute resolution,relief right and internal supervision,among which the right relief reflects the value pursuit of the main channel role of administra-tive reconsideration in resolving administrative disputes.Multiple functions led by right relief coexist,which can effectively respond to the practical needs of the reconsideration system and play the role of the main channel.As the legislative purpose of the new administrative reconsideration law,the main channel clause plays an overall role in the specific system design.From the perspective of integrity,administrative reconsideration system has institu-tional advantages compared with administrative litigation,which is the basis for administrative reconsideration to play its role as the main channel in resolving administrative disputes.In the process of system revision,we should further take the advantages of the system of administrative reconsideration,further reform the jurisdiction system of administrative reconsideration,expand the scope of accepting cases,and enhance the ability of reconsideration by means of information technology.关键词
