Abstract
Exploring the modernization of information network crime requires a new interpretation of accomplice subordination,and in the current era of information network,the principles of traditional restricted subordination and accomplice subordination have been challenged by practice.We should interpret the principle of accomplice subordination in line with the characteristics of information network crime.We should acknowledge there is a situation where the total amount of legal interests infringed by accomplices is greater than that by perpetrators.We should also acknowledge when accomplices or perpetrators conduct new and independent infringements with their means or actions,the crime is no longer subject to the theory of accomplice subordination.Information network crime commits new and independent infringements,the specific impact factors of which are"number of people"and"dissemination".When the means or actions do not have the specific impact factors of"number of people"or"dissemination"or the means or actions are subordinate to the actions of perpetrators,the crime should still be subject to accomplice subordination.关键词
