Study on the Dilemma and Countermeasures of Homestead Circulation under the Background of"Separation of Three Rights"
摘要
Abstract
With the steady and careful promotion of the"three-right separation"of homestead and the continuous improvement of the registration and certification process of real estate integration homestead,the utilization and revitalization of rural homestead have become the focus of the moment.The policy of separation of three rights has caused conflicts between property attributes of homestead and personal restrictions,and the combination of homestead circulation and market mechanism.By analyzing the defects of ownership expression,legal disputes over the circulation of use rights,difficulties in defining membership rights and multiple causes behind them,combined with typical cases in pilot areas,this paper discusses how to solve the problems of homestead circulation from the angles of perfecting homestead ownership,clarifying membership rights and moderately activating homestead circulation.It provides another direction for deepening the reform of homestead.关键词
