论"双碳"目标下《电力法》的修订
Revision of the Electricity Law under the"Dual Carbon"Goal
摘要
Abstract
At present,there are legislative loopholes in Electric Power Law of the People's Republic of China(the Electricity Law),such as legislative positioning deviation,outdated value concepts,and insufficient basic systems,which deviate from the current major policy direction of the country.Under the background of carbon peaking and carbon neutrality goals,the Electricity Law should be revised to incorporate the important qualities of a new type of power system that is safe and efficient,clean and low-carbon,flexible and intelli-gent,and to highlight the"dual-carbon"orientation of the legislation.In view of this,the Electricity Law should undergo a"trinity"innovation in terms of legislative orientation,value concepts,and basic systems.In terms of legislative orientation,the Electricity Law should shift from"Administrative Management Law"to"Economic Law".In terms of values,the Electricity Law should implement the concepts of sustainable development and marketization.In terms of basic systems,the Electricity Law should improve the power plan-ning system at the macro level.Efforts should be concentrated on the"three sides"at the micro level:supplementing the renewable en-ergy system on the power generation side,promoting the construction of smart grids on the transmission and distribution side,and im-proving the electricity pricing mechanism on the sales side.关键词
