Xi Jinping's New Judgments,New Views,and New Measures on Administration by Law
摘要
Abstract
President Xi Jinping's original contributions to the discourse on governance according to law should be analyzed from three perspectives:the differences in the modernization of administrative rule of law between China and the West,the developmental history of legal thought within the Communist Party of China,and the evolution of the principal contradictions in Chinese society.President Xi Jinping has articulated 6 new assessments regarding the practical challenges of administration by law,12 new ideas and viewpoints on how to promote administration by law,and 25 new measures to steadily promote administration by law.These new assessments,perspectives,and measures have addressed longstanding challenges in the realm of law-based administration and established numerous robust systems and mechanisms to advance administration by law,achieving unprecedented milestones in China's construction of a government based on rule of law.However,significant disparities persist in the level of law-based administration across different regions of China.Governmental levels and their departments have yet to comprehensively outline power mandates,negative lists,and scope of responsibilities.Meanwhile,a host of issues persist in administrative enforcement,including instances of"inaction without clear indicators and erratic actions despite indicators."Therefore,Chinese theories and practices of administration by law necessitate further innovation,a requirement underscored by China's distinctive path to modernization.关键词
