海事行政执法中无人机取证的合法性规制及建议
Legitimacy Regulation and Suggestions for Unmanned Aerial Vehicle Evidence Collection in Maritime Administrative Law Enforcement
摘要
Abstract
With the technological development of maritime supervision,unmanned aerial vehicle(UAV)cruise has become an important way of evidence collection for maritime administrative penalty with its advantages of high efficiency and rapidity,multi-dimensional perception,economy and safety.In order to ensure the regulated application of data collected by UAV and avoid the occurrence of illegal evidence exclusion,this paper clearly expounds that the data collected by UAV has the legal status of evidence as electronic data,and the legitimacy regulation of such data is conducted from the three aspects of subject,form and procedure.It proposes the whole-process regulatory requirements covering the publication of the information prior to the collection of evidence,the precautions taken in the process of evidence collection,and the evidence audit and preservation.It also puts forward comprehensive development suggestions for UAV-assisted law enforcement and evidence collection from the aspects of training professionals,building management systems and establishing management platforms.关键词
