数智时代结构要素变化下少年司法机制的构建
The Construction of Juvenile Justice Mechanism with Changes of Structural Elements in Digital Intelligence Era
摘要
Abstract
The arrival of digital intelligence era has propelled the judicial protection of minors from traditional to intelligent judicial stage.The integration of digital information technology into judicial activities has led to changes in the structure,protection subjects,and scope of juvenile justice,and promoted development of intelligent juvenile justice.However,there are differences in the development speed between juvenile justice and digital intelligence technology,which lead to three major dilemmas in the development of juvenile justice:deficiencies of specialized legislation,imbalanced data infrastructure construction,and clarification of distribution responsibilities.Therefore,it is necessary to establish an integrated,procedural,and standardized smart juvenile justice mechanism that is in line with the digital intelliegence era,based on innovation of judicial system,application of digital technology,and legal supervision.This will ensure independent operation of juvenile justice,eliminate existing problems such as data silos,algorithmic discrimination,and information leakage,promote"justice-technology"integration,and optimize juvenile justice mechanism with Chinese characteristics with changes of structural elements.关键词
