南京国民政府时期战时民事调解制度研究
Study on Wartime Civil Mediation System in Nanjing National Government Period
摘要
Abstract
In order to cope with the severe impact of the war of resistance against Japan on the civil rela-tions in China,the National Government of Nanjing revised and improved the civil mediation system.The war-time civil mediation system has modified the original provisions of the Civil Procedure Law from the aspects of mediation scope,mediation institutions,mediation procedures and mediation results.The wartime civil media-tion system strengthened the rigid provisions of the civil mediation system,made up for the shortcomings of the original civil mediation system,and helped to improve the efficiency of civil mediation.However,the wartime civil mediation system changed the meaning and nature of the original civil mediation,and the mandatory provi-sions in the wartime civil mediation system also made it abolished shortly after the end of the war of resistance.关键词
