基于实证的网络谣言犯罪量刑之反思
Reflection on the Sentencing of Network Rumor Crime Based on Empirical Evidence
摘要
Abstract
Through the empirical study of relevant criminal judgment documents by SPSS25.0 software,it can be found that the sentencing of network rumor crime cases shows a trend of heavier punishment and the probation rate is relatively low,and there are certain degrees of differences between the sentencing results of cases of different trial levels and regions.Such cases of sentencing results overall comprehensive consideration of the different kinds of sentencing,clicks(views)did not become the main sentencing plot,"positive refund or the victim understanding""cause the victim or their close relatives mental disorders,suicide and other serious consequences"and previous record sentencing circumstances did not significantly affect the sentencing results.In order to improve the sentencing system of such crimes,we should straighten out the relationship between severe punishment and moderately light punishment,appropriately expand the probation application rate of lenient cases,improve the scope and degree of sentencing standardization,and strengthen the supporting role of guiding cases.关键词
