城管柔性执法的表象、问题与完善
The Appearance,Problems,and Improvement of Flexible Law Enforcement in Urban Management:From the Perspective of Administrative Law Enforcement Reform under the"Comprehensive Integration"in Zhejiang Province

Abstract
Under the background of"comprehensive integration",flexible law enforcement has been injected with new connotations,and its discretion and authority are the most representative characteristics.Flexible law enforcement has broken through the previous"non-mandatory"applicable space,no longer staying at the level of persuasion and education,but entering the"discretionary power under general prohibition".The sinking of power provides the legitimacy basis for the authority of urban management law enforcement personnel.However,the"illegal chaos"and"law enforcement farce"exposed in practice also serve as a warning to the unclear application space and lack of authority of flexible law enforcement in urban management.Regulating the exercise of"discretionary power under general prohibition",building a solid foundation for the authority of flexible law enforcement,and promoting the digital process of flexible law enforcement,all these can help clarify the applicable space of flexible law enforcement,reshape the authority of flexible law enforcement,and better safeguard urban management work through flexible law enforcement.关键词
