Research on Legal Issues of Essentially Derived Varieties
摘要
Abstract
The 2021 amendment to the Seed Law established a system for essentially derived varieties(EDV),specifying that EDVs can apply for and obtain new plant variety rights.However,commer-cial use of these varieties requires consent from the original variety's plant variety rights holder.The core of this system is to establish a benefit-sharing mechanism between the original variety rights holder and the derivative variety owner,reflecting respect for the intellectual property of the original breeders and strengthening the protection of their rights,thereby encouraging original innovation.By analyzing the historical development and theoretical foundation of this system,and examining the scope of protection for original breeders'rights,methods of proof,identification of legal subjects,and burden of proof rules in foreign implementations,this text put forward recommendations on impro-ving the implementation of the EDV system in China as follows:identifying the subject,establishing a variety list system,improving identification methods,clarifying the allocation of the burden of proof,and establishing a multi-disciplinary dispute resolution mechanism.关键词
