Upholding Fundamental Principles and Breaking New Ground:Advancing the Fourth Amendment of the Criminal Procedure Law of the People's Republic of China

Abstract
In September 2023,The Legislative Plan of the Standing Committee of the 14th National People's Congress included the fourth amendment of the Criminal Procedure Law of the People's Republic of China in its legislative agenda for consideration during the committee's term.This amendment differs significantly from the previous three in terms of its background and requirements,especially in light of the evolving demands of the New Era.The process of revising the law faces numerous challenges.This paper analyzes these challenges in detail,including the guiding principles,standards,and requirements for the amendment;the emphasis on upholding"procedural justice";the adoption of a"scientific and open approach"to legislative reform;the integration of the United Nations'minimum standards for criminal justice;and the alignment of the amendment with the Supervision Law.Moreover,key aspects of the amendment are briefly discussed,such as balancing the legislative principle of"stressing broad,flexible guidelines over rigidly detailed prescriptions"with the need for precision in both lawmaking and judicial practice.关键词
