《刑事诉讼法》再修改与相关法律的衔接协调问题
Coordination Issues between the Revision of the Criminal Procedure Law and Related Laws
摘要
Abstract
In the fourth revision of the Criminal Procedure Law of the People's Republic of China,attention should be paid to the connection and coordination between the law and other laws such as the Supervision Law,the People's Jurors Law,the Legal Aid Law of the People's Republic of China,and the Judges Law of the People's Republic of China,in order to solve the problems of gaps,omissions,and conflicts with relevant laws in the Criminal Procedure Law.The above-mentioned problems can be resolved through the approach of"internal and external integration","coordination and consistency",and"filling in gaps".In the process of coordination and coordination,attention should be paid to maintaining the unity and core of the Criminal Procedure Law of the People's Republic of China,and taking into account the special application of current specialized laws.The supply and demand for the litigation system in some special criminal fields can be addressed by adding"special procedures"or adding"preliminary investigation"procedures,special investigation(investigation)measures,et cetera,to the Criminal Procedure Law of the People's Republic of China.This can not only avoid confusion in the application of criminal procedure legal norms,but also enhance the quality and authority of the Criminal Procedure Law of the People's Republic of China as the basic law of criminal procedure.The revision of the Criminal Procedure Law should highlight this issue in order to achieve the completeness,coordination,and unity of criminal procedure legal norms.关键词
